A Guardian Ad Litem may be considered the voice of a child during a Child Time-sharing case after a separation, marriage divorce or dissolution. The Guardian Ad Litem is either appointed solely by the judge or at the request of either parent to take charge of a case and give accounts of the facts he or she has gathered in relation to who may be the best fit for the child’s best interest. A Guardian Ad Litem is granted the authority to conduct interviews on witnesses and anyone who is close to the child. In other words, the Guardian Ad Litem is a neutral party from the parents as listed in Florida Statute 61.403.
